Professional License Agreement

Executive Function Express™ Treatment Builder™ (EFX-TB™)

Thank you for purchasing the Executive Function Express™ Treatment Builder™ (EFX-TB™).

This agreement explains how your purchase may be used, outlines professional and privacy responsibilities, and helps protect the integrity of the EFX-TB™ system for all licensed professionals.

By purchasing, accessing, or using the EFX-TB™, you agree to the terms outlined below.

Individual Professional License

Your purchase includes an Individual Professional License for one professional user.

This license allows one professional to access and use the EFX-TB™ within their own clinical, educational, or consulting practice.

The license is non-transferable and may not be shared with other individuals.

What's Included

Your Individual Professional License includes access to:

  • The digital EFX-TB™ Treatment Builder

  • Individual child/client case workspaces

  • Clinical reasoning and treatment-planning tools

  • Executive function and interoception-informed support recommendations

  • Treatment and intervention ideas

  • Present Level/Child's Story support

  • Goal-development tools

  • Progress monitoring features made available within the program

  • Downloadable or generated professional resources made available within the program

  • Product updates made available to licensed users

Features and available resources may be updated or expanded over time.

Permitted Use

As a licensed professional, you may:

  • Use the EFX-TB™ within your own professional practice.

  • Create treatment plans and intervention ideas for the clients, students, or patients you personally serve.

  • Use generated information to support clinical reasoning, intervention planning, documentation, and goal development.

  • Download, retain, and incorporate generated treatment-planning materials into your own professional documentation when appropriate.

  • Adapt generated recommendations and treatment ideas to meet the individual needs, strengths, interests, setting, and circumstances of the person you are supporting.

License Restrictions

Your Individual Professional License does not permit:

  • Sharing your EFX-TB™ login credentials with another individual.

  • Allowing another professional to use your individual license.

  • Copying, reproducing, distributing, reselling, or commercially repackaging the EFX-TB™ system or its proprietary content.

  • Providing access to the EFX-TB™ through a shared organizational login.

  • Uploading proprietary EFX-TB™ resources, instructional materials, or program content to another website, shared drive, learning management system, or other location for use by unlicensed individuals.

  • Reproducing the EFX-TB™ framework, logic, prompts, structure, or proprietary content to create a competing or derivative treatment-planning product.

  • Representing EFX-TB™ generated materials or proprietary content as an independently developed commercial product.

Professionals may retain and use individualized treatment plans, goals, documentation, and other outputs generated through their authorized use of the EFX-TB™ as part of legitimate professional service delivery.

All EFX-TB™ proprietary materials remain the intellectual property of the Executive Function Institute.

Organizational Licensing

The Individual Professional License is intended for use by one professional only.

Schools, clinics, healthcare organizations, universities, and other organizations wishing to provide EFX-TB™ access to multiple professionals must obtain an Organizational License.

Please contact the Executive Function Institute™ for organizational licensing information.

Privacy & Student/Client Information

The EFX-TB™ should not be used to enter or store protected health information (PHI) or personally identifiable student/client information unless and until the Executive Function Institute™ expressly indicates that the EFX-TB™ is being provided through a HIPAA-enabled environment appropriate for such use.

When creating a child/client workspace or entering information into the EFX-TB™, users should use initials, a case identifier, or another non-identifying reference rather than a full name or other direct identifiers.

Do not enter information that is unnecessary for treatment planning or that could independently identify the student, client, or patient.

Licensed users remain responsible for following their organization's privacy, security, documentation, and data-handling requirements when using information generated through the EFX-TB™.

Professional Responsibility

The EFX-TB™ is designed to support, not replace, professional clinical reasoning and judgment.

Recommendations, treatment ideas, goals, supports, documentation language, and other generated content should be reviewed by the professional before use and individualized based upon the student's or client's strengths, needs, current presentation, environment, communication, available supports, and other relevant information.

The licensed professional is responsible for determining whether generated recommendations are appropriate for a particular individual, setting, and situation.

The EFX-TB™ is not intended to provide a medical diagnosis, independently determine eligibility for services, or replace comprehensive evaluation when additional assessment is indicated.

EFX-AP™ and EFX-TB™ Use

The EFX-AP™ and EFX-TB™ are complementary professional tools but are licensed and operated separately.

Information from an EFX-AP™ assessment may be used by the professional to inform clinical reasoning and treatment planning within the EFX-TB™. However, professionals should not transfer identifying information or PHI from an EFX-AP™ report into the EFX-TB™ when the EFX-TB™ is being used in a non-HIPAA-enabled environment.

When carrying information between systems, use only the non-identifying clinical information necessary for treatment planning.

Product Updates

The Executive Function Institute™ may periodically update the EFX-TB™ to improve functionality, clinical reasoning support, treatment recommendations, educational resources, user experience, or available features.

Licensed users may receive access to applicable updates as part of their active EFX-TB™ access.

Copyright & Intellectual Property

The Executive Function Express™ Treatment Builder™ (EFX-TB™), including its framework, clinical reasoning structure, treatment-planning system, written content, graphics, forms, generated-resource structure, and accompanying materials, is protected by United States copyright law and other applicable intellectual property protections.
