Executive Function Express™ Access Profiler™ (EFX-AP™)

Thank you for purchasing the Executive Function Express™ Access Profiler™ (EFX-AP™) Professional Assessment Package.

This agreement explains how your purchase may be used, outlines privacy and security responsibilities, and helps protect the integrity of the EFX-AP™ system for all licensed professionals.

By purchasing, accessing, or using the EFX-AP™, you agree to the terms outlined below.

Individual Professional License

Your purchase includes an Individual Professional License for one professional user.

This license allows one professional to access and use the EFX-AP™ Professional Assessment Package within their own clinical, educational, or consulting practice.

The license is non-transferable and may not be shared with other individuals.

Automated individualized EFX-AP™ reports
The Professional User Manual
The Professional Video Training Library
Executive Function Express™ framework resources
Clinical reasoning and intervention-planning resources
The password-protected Professional User Portal
Product updates made available to licensed users

Permitted Use

As a licensed professional, you may:

Use the EFX-AP™ within your own professional practice.
Complete assessments for your clients, students, or patients.
Generate, download, and retain individualized EFX-AP™ reports as part of your professional documentation.
Share an individual report with authorized members of a student's or client's care or educational team when permitted by applicable law and organizational policy.
Use the Professional User Manual, Professional Video Training Library, and accompanying resources to support assessment, clinical reasoning, documentation, and intervention planning.

License Restrictions

Your Individual Professional License does not permit:

Sharing your Professional User Portal credentials or EFX-AP™ report password with unauthorized individuals.
Allowing another professional to use your individual license.
Copying, reproducing, distributing, or reselling any portion of the EFX-AP™ Professional Assessment Package.
Uploading the assessment, manual, videos, or other licensed materials to another website, shared drive, cloud storage platform, learning management system, or other location for use by unlicensed individuals.
Modifying copyrighted materials for redistribution or commercial use.
Creating derivative assessment products based upon EFX-AP™ content.

Individual assessment reports may be stored, uploaded, or shared as necessary for legitimate professional documentation and service delivery, provided this is done in accordance with applicable privacy requirements and organizational policies.

All EFX-AP™ materials remain the intellectual property of the Executive Function Institute™.

Organizational Licensing

The Individual Professional License is intended for use by one professional only.

Schools, clinics, healthcare organizations, universities, and other organizations wishing to provide EFX-AP™ access to multiple professionals must obtain an Organizational License.

Privacy, Security & Protected Information

The EFX-AP™ is administered through a HIPAA-enabled Jotform environment with safeguards designed to support the secure collection, storage, and delivery of protected health information (PHI).

Student and client information is protected through multiple layers of security, including encrypted data transmission and storage, protected handling of PHI, and password-protected individualized PDF reports.

Identifying information is not included in the standard email message used to deliver an individualized report.

Licensed users are responsible for:

Maintaining the confidentiality of their Professional User Portal credentials and EFX-AP™ report password.
Restricting access to EFX-AP™ reports to authorized individuals.
Appropriately securing reports after they are downloaded or transferred from the EFX-AP™ system.
Following applicable federal, state, professional, employer, and organizational requirements governing privacy, security, documentation, record retention, and disclosure of student or client information.

The use of HIPAA-enabled technology and security safeguards within the EFX-AP™ does not replace the licensed user's or organization's responsibility for maintaining appropriate privacy and security practices within their own systems and professional environment.

Professional Responsibility

The EFX-AP™ is a professional assessment and clinical reasoning resource. Results are intended to be interpreted within the context of the individual's strengths, needs, environment, supports, task demands, and other relevant information available to the professional.

The EFX-AP™ does not replace professional judgment or other assessment procedures when additional evaluation is indicated.

Licensed users are responsible for determining the appropriateness of the EFX-AP™ for their setting, population, and intended professional use.

Product Updates

The Executive Function Institute™ may periodically update the EFX-AP™ Professional Assessment Package to improve functionality, educational resources, privacy and security practices, clarify guidance, or expand available materials.

Licensed users may receive access to applicable updates through the Professional User Portal.

Copyright & Intellectual Property

The Executive Function Express™ Access Profiler™ (EFX-AP™), Professional User Manual, Professional Video Training Library, assessment content, reports, graphics, forms, scoring systems, framework materials, and accompanying resources are protected by United States copyright law.

Unauthorized reproduction, distribution, modification, resale, or commercial use of any portion of the EFX-AP™ Professional Assessment Package is prohibited.
